Raghav Chadha moves Delhi HC to prevent government bungalow eviction
Aam Aadmi Party (AAP) MP Raghav Chadha moved the Delhi High Court on Tuesday against a trial court's order which paved the way for his eviction from the government bungalow allotted to him. The matter has been listed for Wednesday, reported Live Law. Chadha was allotted a Type VII bungalow in September last year, and he took its possession in November 2022. He previously lived in a Type VI bungalow and was later granted the Type VII bungalow on request.
Chadha doesn't have right to occupy: Rajya Sabha Secretariat
A trial court in Delhi last week quashed an interim order from April 18 that barred the Rajya Sabha Secretariat from evicting Chadha from the bungalow without due process. Hearing a review application filed by the RS Secretariat, the court observed that Chadha "cannot claim an absolute right" to stay in the property after its allotment has been canceled. It noted that the allotment of government accommodation is only a privilege, not a vested right.

The RS Secretariat had also contended that Chadha was granted interim relief without following the procedure laid out under Section 80(2) of the Code of Civil Procedure (CPC). The court ultimately dismissed Chadha's argument that the allotment made to an MP can't be annulled until their term ends. The legal tug-of-war ensued after Chadha filed a suit against the secretariat for canceling the allotment in March. Chadha claimed he would suffer harm if evicted since he lives with his parents.
Meanwhile, Chadha also moved SC against RS suspension
On the other hand, the Rajya Sabha MP from the AAP also moved the Supreme Court on Tuesday challenging his "indefinite suspension" from the Parliament's Upper House. Terming it "arbitrary and illegal," Chadha said the Privileges Committee of the Rajya Sabha hasn't yet taken any action on the suspension matter, claiming it was being delayed "indefinitely."
Why Chadha was suspended from House
To recall, Chadha was suspended from the Rajya Sabha back in August during the Monsoon Session of the Parliament. He was accused of "breach of privilege" after four MPs claimed he didn't take their consent before naming them in a proposed select committee for the Delhi services bill. He was also reportedly accused of forging the signatures of five MPs.
