Delhi court allows FIR against Kejriwal for public fund misuse
What's the story
Delhi's Rouse Avenue Court has granted a petition for an FIR against Aam Aadmi Party (AAP) chief Arvind Kejriwal.
The complaint states that Kejriwal, former AAP MLA Gulab Singh, and Dwarka Councillor Nitika Sharma misused public funds in 2019.
The misuse allegedly involved putting up large hoardings across the Dwarka area at taxpayers' expense.
Case revival
Previous dismissal overturned, case reopened
In September 2022, a metropolitan magistrate had dismissed the complaint against Kejriwal and his associates.
However, this was overturned by the sessions court, which ordered the magistrate to reconsider the matter.
Following a direction from Special Judge Vishal Gogne in January, the magistrate court entertained a plea for an FIR to be registered.
Compliance deadline
Police to file compliance report by March 18
The new petition filed under Section 156(3) of the Code of Criminal Procedure (CrPC) gives the magistrate the power to ask the police to file an FIR and investigate a cognizable offense.
The court has asked the police to file a compliance report by March 18.
This comes as another legal challenge for Kejriwal, who is currently out on bail in a case related to the alleged Delhi liquor policy scam.
