Mumbai: Man gets justice 18-years after death, thanks to son
Father's day is some months away, but a Mumbai man's posthumous gift for his father calls for a celebration already. 18 years ago, Ganesh Jagtap's father was accused of hitting a man, for which a trial court awarded him a 3-month imprisonment. After his father died in 2004, he continued the fight to clear his name, and finally succeeded.
Past animosity casting doubt on case outcome: Bombay HC
Ganesh's father Balasaheb supposedly hit an MSRTC conductor in November'98; the two were already embroiled in a legal case. The assault left the conductor bleeding, for which Balasaheb was given the sentence. HC judge Prakash Naik observed their past animosity is casting a doubt over the case; the injuries of the conductor can well be due to a fall from the bus, he noted.
'Incident happened at bus stand, how come no independent witnesses?'
After Balasaheb died, Ganesh was allowed to pursue the case. Ganesh's advocates Dilip Bodake and Umesh Yadav pointed out the absence of witnesses even though it allegedly happened at a Satara bus-stand. They also dug up the conductor's past: he had been dismissed for overcharging passengers. HC finally ruled in Ganesh's favor, freed his father and ordered financial compensation if Balasaheb was ever fined.
