Triple talaq ban: What will happen to all pending cases?
Three days ago, after months of debates, the SC finally suspended the "unconstitutional" triple talaq till the government frames relevant laws. The ramifications of the verdict are slowly getting clear. For one, the judgement affects all cases where women have challenged triple talaq given to them by their husbands, legal experts say. Their marital status is likely to be restored.
'SC verdict binding on all courts'
Former Jharkhand HC judge Ajit Sinha says the apex court's order is binding on all courts. "There is no question of other courts having to examine the validity of triple talaq now after the SC verdict and so all cases will go."
But sooner said than done
However, it will take time for the new law to be accepted. Hours after the ban, a Meerut resident divorced his pregnant wife using the same provision. Though a case was filed, legal expert Virag Gupta said there's no clarity on what action should be taken. The AIMPLB is yet to release an "official stand" after internal deliberations.
