Now, Muslim grooms to take oath against triple talaq
While getting married, Muslim men will now have to promise that they would never give their wives triple talaq. The All India Muslim Personal Law Board (AIMPLB) is set to amend the Islamic marriage contract (nikahnama) to cut down the practice of instant divorce. After agreeing to the modified nikahnama, any attempts of giving triple talaq will be considered invalid. Here's more.
How will the model nikahnama help?
The AIMPLB will release a "model nikahnama" during its annual convention in Hyderabad from February 9-11, making it compulsory for every groom to take an oath to not divorce his wife through triple talaq. However, if he gives an instant divorce despite the undertaking, it'd be considered void under the Shariah (Muslim personal) law, giving his wife the right to challenge it in court.
Meanwhile, Triple talaq bill yet to be passed by RS
The AIMPLB's decision comes a month after the Lok Sabha cleared the Muslim Women (Protection of Rights on Marriage) Bill. However, it is yet to be passed by the Rajya Sabha. Once done, giving triple talaq will become a criminal offense. However, despite the Supreme Court banning the notorious practice in August last year, it is still prevalent across India.
People laud AIMPLB's idea of model Islamic marriage contract
Since a majority of Muslims follow Shariah rules for matrimonial issues, the AIMPLB's latest move might hold water. Maulana Wali Rahmani, AIMPLB's general secretary, told Times of India that though the nikahnama has always discouraged instant divorce, the new amendment would help to completely stop it. Several Islamic bodies, women and certain progressive men across India have hailed the AIMPLB's decision.
