Goa man seeks quashing of molestation case against him
A deputy sarpanch of a village in Goa has moved the Bombay HC seeking quashing of an FIR filed against him based on a complaint of molestation lodged by a woman Shiv Sena leader in the state. Abhijit Desai, deputy sarpanch of Netravali village of Sanguem taluka of South Goa, filed a petition in the High Court of Bombay at Goa earlier this week.
Woman lodged complaint against Desai for defamatory post on Facebook
In his affidavit, Desai said the woman had lodged a complaint against him accusing him of putting a defamatory post on Facebook. "The complaint bears no date. However, it was apparently inwarded in the office of the CM on July 14, 2018, and the CM marked the same to SP (Superintendent of Police), Cyber Crime for 'appropriate action' on July 17, 2018," he said.
Case is likely to be heard on October 19
The affidavit said the complaint was thereafter marked to the Office of the SP and finally forwarded to the Inspector Cyber-Crime Cell, who without conducting inquiry and apparently under CM's pressure, rushed to register the FIR under Sections 500, 509 of IPC. Cyber-Crime Cell had filed the FIR against Desai on July 19, 2018. The matter is likely to be heard on Oct 19.
