Favoring eloped couple, Kerala HC says 'love is blind'. Respect!
Setting aside a college order that expelled a couple for eloping, the Kerala High Court recently said, "Love is blind and an innate humane instinct." The woman and her senior were rusticated from a Kochi college, that termed eloping as a breach of discipline. Hearing the petition, Justice A Muhamed Mustaque observed it was all about individuals and their choices.
The relationship of couple was accepted by families
The 20-year-old woman and 21-year-old man studied BBA at a college in Kollam district. The woman joined the college in 2016-17. Facing objection from college authorities and their parents, the couple had eloped. However, the parents stood by the couple in court and said they approved of their relationship. This must have further left the college red-faced.
College said couple's 'intimate relationship' hindered congenial environment
To justify their action, the college said the couple indulged in 'intimate relationship' on the campus, and it affected the congenial environment of the institution. But the 'bald allegations' couldn't be supported with evidence during the hearing. On this, the court said, "Except with legislative essentials no regulation can be made to regulate the behavior of men on moral values."
College can't interfere in personal relationships, court said
Giving the judgement, the court directed the college to allow the woman to continue her classes. The authorities will also have to return the academic documents of the man. Justice Mustaque said personal relationships were a private matter of individuals and the college had no right to interfere in it. "Love is blind and an innate humane instinct," the court observed.
