Marketing campaign allegedly misled consumers
The lawsuit claims that Apple's massive ads on all platforms, established a "clear and reasonable consumer expectation" that these features would be available when the iPhone launched.
It adds, "This drove unprecedented excitement in the market...as part of Apple's ongoing effort to convince consumers to upgrade at a premium price and to distinguish itself from competitors deemed to be winning the AI arms race."
The suit also alleges that Apple misled consumers about its AI capabilities.
Misrepresentation
Apple allegedly overstated its AI capabilities
According to the lawsuit, "Contrary to Defendant's claims of advanced AI capabilities, the Products offered a significantly limited or entirely absent version of Apple Intelligence."
The suit argues this misled consumers about the actual utility and performance of these products.
It further states, "Defendant promoted its Products based on these overstated AI capabilities," leading consumers to believe they were purchasing devices with features that did not exist.

Siri advertisement removed from YouTube
An Apple representative wasn't immediately available for comment on the lawsuit, Axios reports.
The suit specifically mentions an ad from September featuring actor Bella Ramsey promoting Siri capabilities that are now delayed.
It notes that although Apple recently removed this ad from YouTube, "It has failed to retract all the similarly false representations in the market that began in the Summer of 2024, much less take any action that would adequately remedy the consumers harmed by the company's widespread deception."
